Clients may appeal to the Financial Dispute Arbitrator (ACF), established at CONSOB, for the out-of-court resolution of disputes between investors (excluding professional clients) and independent financial advisors and financial consulting companies under Articles 18-bis and 18-ter of the TUF, regarding breaches of diligence, fairness, information, and transparency obligations under Part II of the TUF, including disputes covered by Regulation (EU) No. 524/2013. Disputes requesting amounts exceeding €500,000 or non-direct, non-patrimonial damages are excluded. Under Art. 165(1)(h-bis) of the Intermediaries Regulation, IFA Consulting integrates an assessment of environmental, social, and governance (ESG) factors when selecting financial instruments for investment advisory services. Products are recommended only to clients whose sustainability preferences align with the characteristics of the instruments.
Since IFA Consulting’s advisory covers the overall portfolio, ESG assessment is conducted at the portfolio level. Some individual instruments may not fully align with client preferences due to risk management or objective achievement.
ESG characteristics are evaluated based on issuer-provided information under applicable regulations, external rating models, and/or internal analyses.
No consideration of negative sustainability impacts
Currently, due to partial data availability from manufacturers, negative sustainability impacts cannot be considered in the advisory service. IFA Consulting will periodically review data availability and consider including negative impacts when sufficient information is available.
Consistency of remuneration policies with sustainability risk integration
IFA Consulting considers sustainability risks in organizational compliance and remuneration practices. Payments to third-party providers are structured to avoid conflicts with sustainability-based instrument selection.
